POSITION SUMMARY

Provides legal advice and representation to the Board of Commissioners, the Department of Human Services, and Moffat County Elected Officials and Department Heads. Negotiates, prepares, and enforces leases and other contracts to which the County is part. Represents the County in connection with litigation, administrative proceedings, settlement discussions and similar adversary proceedings except as to insured claims, and in connections with insured claims, monitors any related litigation being handled by private attorneys.

MINIMUM QUALIFICATIONS REQUIRED:

Education and Experience:

· Licensed to practice law in the State of Colorado.

· At least 5 years of experience as a practicing attorney with experience in some or all of the following areas of law: litigations, family law, child support, employment law, Natural Resources, collections, subdivision and zoning, federal, state, and local government law, contracts, and civil rights law.

Licenses and Certifications:

· Knowledge of state and county court practices and procedures (including Colorado Rules of Civil and Criminal Procedure and County Court Rules of Procedure); discovery and trial practices; and law office procedures and practices.

· Applicable state, federal and local ordinances, codes, laws, rules and regulations, court cases, legal precedents, administrative regulations, and legislative issues.

· Methods and techniques of research, statistical analysis, and report presentation.

· All computer applications and hardware related to performance of the essential functions of the job.

· Correct English usage, including spelling, grammar, punctuation, and vocabulary.

· Internal departmental policies and procedures.

· County governmental organization and operations.

· External governmental bodies and agencies related to area of assignment.

ESSENTIAL JOB FUNCTIONS: (All responsibilities may not be performed by all incumbents.)

· Represents the BOCC (directly or through County departments), other elected officials, and any other assigned appointed agency of the Board of County Commissioners, as both the plaintiff and the defendant, in administrative actions and court cases as needed or required. If authorized, may act as the agent of the County in negotiations or mediation and in specified legal or business transactions.

· Advises County departments and elected officials as to the statutory and regulatory authority of County officials, legal rights, obligations, procedures, confidentiality issues, and evidentiary privileges as needed or required.

· Maintains knowledge of current state and federal constitutional issues, statutes, court decisions, and County resolutions and ordinances related to client departments and general County law (i.e., Public Records Act, Public Meetings Act, the County Powers, and Functions statute).

· Prosecutes lawsuits (County Court, Small Claims, District Court) and civil administrative procedures; prepares pleadings and other legal documents; assembles evidence to formulate a defense or initiate administrative or court actions; conducts discovery; represents clients in court and before quasi-judicial and administrative agencies; and examines legal data and department case files to determine advisability of defending or prosecuting actions as needed for representation of primary client departments and as directed by the BOCC.

· Carries out managerial responsibility in accordance with policies, procedures, and applicable laws including: interviewing, hiring and training, planning, assigning, and directing work; establishing deadlines; appraising performance; rewarding and disciplining employees; and addressing complaints and resolving problems.

· Plans, coordinates, assigns, and monitors performance and coaches, counsels, mentors, trains, and advises employees in department for the dual goals of meeting department goals, BOCC goals, and employee career development.

· Oversees the preparation of the budget and manages contracts, including: providing accounting of expenditures; preparing and submitting requests/purchase orders for operating, personnel, and capital budget; providing and presenting financial information, data, and history to justify requests and to aid in discussions with officials; negotiating contracts; monitoring the work of contractors and assuring that work is done in compliance with contract specifications; assisting with the grant writing process; and participating in related meetings.

· May work with the Department of Human Services directly in representing and defending the department in legal matters as needed or directed.

· May work with the Natural Resources Department regarding Natural Resource litigation involving Natural Resource federal land use, BLM land, oil and gas, and other local, state, and federal Natural Resource issues.

· May work with the Human Resources Department regarding litigation involving employment law, worker’s compensation, and unemployment.

· Confers with other governmental agencies (state, federal, and county) on general legal matters and specific cases as needed.

· Develops and maintains internal office relationships with the goal of efficiency within the County Attorney’s Office and functional working relationships with client departments, representatives of the community and governmental agencies, and the general public on an ongoing basis.

· Interprets, develops, communicates, updates, and/or monitors ordinances, policies, procedures, and standards for the department and County.

· Plans and implements short-term, long-term, or annual goals, objectives, organizational structure, and strategies for the department, projects, or programs to ensure efficient organization and completion of work.

· Establishes and maintains effective working relationships with County officials and employees, other attorneys, representatives of community and governmental agencies, and the public.

· Performs administrative functions relating to the County Attorney’s office.

 

IMPORTANT JOB FUNCTIONS:

· Regularly reviews new case laws, statutes, and regulations having possible application to the County and provides advice regarding compliance with and implications of changes to the existing laws as required.

· Attends hearings and meetings of the BOCC and various County boards and commissions as needed or directed.

· Evaluates claims against the County and monitors claims handled by insurers as required.

· Drafts and reviews leases, contracts, and other legal documents as required.

· Meets with and otherwise communicates with the public, other governmental entities, and the press relating to County legal matters.

· Performs other related duties as assigned.
